NYS Updates Model Sexual Harassment Policy and Training Materials

As you are aware, New York employers are required to maintain and distribute a sexual harassment policy to employees, as well as to conduct annual sexual harassment prevention training.
 
New York State recently updated the State’s model sexual harassment policy, standards, and training materials. Employers can view the new materials on the State’s website. There are a number of language and substantive changes to the State’s model policy concerning issues such as gender identity, remote work, bystander intervention and the modified harassment standard under the New York State Human Rights Law. The updated model policy also broadens its scope to address other forms of discrimination.
 
We recommend that you review your sexual harassment policy and training materials to ensure that they are in compliance with the State’s updated model documents. Although employers are not required to adopt the State’s model policy, employers are required to adopt a sexual harassment policy that meets or exceeds the State’s minimum standards for sexual harassment prevention policies.
