Kristin M. Burke is Of Counsel with Clifton Budd & DeMaria, LLP.  She dedicates her practice to labor and employment law. She combines her proficiency as a litigator with her substantial experience providing advice and counsel to clients in all aspects of employment and labor law. An experienced trial lawyer, Ms. Burke litigates on behalf of a variety of private and public sector employers in federal and state courts and before federal and state administrative agencies. Those cases include contract administration, labor board proceedings, arbitration and mediation, employment-related claims and wage and hour matters. Ms. Burke also represents clients in cases involving alleged violations of restrictive covenants, breaches of contract, unfair business practices, unpaid commissions, and business tort claims. She conducts seminars and training and advises clients on day-to-day labor and employment law issues. In addition, Ms. Burke counsels clients on the labor and employment aspects of mergers and acquisitions and helps them develop effective strategies and policies.

• Secured a favorable defense verdict in federal breach of contract and discrimination case asserted against commercial real estate company
• Secured a favorable defense verdict in age discrimination case against pharmaceutical company in federal court
• Obtained summary judgment on behalf of hospital dismissing plaintiff's race, gender, gender orientation and disability discrimination claims arising under federal and New York State human rights laws
• Obtained dismissal of Union’s unfair labor practice charge after full hearing before NLRB administrative law judge
• Obtained summary judgment on behalf of town in case asserting fourteenth amendment and retaliation claims
• Obtained summary judgment in gender discrimination case arising under federal and New York State human rights laws
• Awarded substantial attorney's fees after grant of summary judgment motion and loss of appeals by plaintiff in breach of broker contract case against commercial real estate client
• Successfully obtained TRO and settlement on behalf of financial services company in a corporate raiding situation
• Successful resolution of wage and hour claims in class, collective and individual actions
• Advised clients on labor and employment aspects of merger and acquisition of businesses
